4. Exclusions:

This offer is available to residents of all Australian states and territories excluding the Australian Capital Territory (ACT) and South Australia (SA), due to applicable permit restrictions. ACT and SA residents are ineligible to enter this Competition and any entries submitted by such persons will be deemed invalid and will not be included in the Draw.

It is the sole responsibility of the customer to consult their respective state or territory’s eligibility requirements prior to making a purchase. By proceeding with a purchase, the customer acknowledges that they have read, understood, and accepted these terms, and confirms their eligibility to participate in the Competition.

5. Promotion Period:

All entries must be received before the End Date to be eligible for inclusion in the prize draw for the Competition. Entries received after the End Date will not be included in the prize draw and will be deemed invalid for the purposes of this Competition.

The Promoter’s computer systems will be the official timekeeper for the purposes of determining the validity of entries.

6. Eligibility Requirements:

• Entrants must be Australian residents aged 18 years or older at the time of entry.

• Must reside in one of the Eligible Jurisdictions and reside in a valid Australian residential address.

• Entrants must purchase raffle tickets (www.mkbarberaustralia.com.au) prior to the End Date.

• The number of entries allocated to each Competition is as stated on the Website at the time of purchase of either a Member Package or One-Time Package.

• Important Distinction: Only Member Packages and One-Time Packages

• Entries are credited immediately upon successful payment and are valid for this specific Competition. One Time Package Entries do not roll over, carry forward or accumulate to subsequent competition. Member Package Entries, however, do carry forward and accumulate across subsequent competitions in accordance with the Promoter’s membership program.

• Additional entries may be offered through other promotional campaigns, referral incentives, or other offers made available during the Promotion Period at the Promoter’s discretion. Details of such promotional offers will be published on the Promoter’s Website and are subject to change with reasonable notice.

• Multiple One-Time Packages may be purchased to accumulate entries, subject to the maximum entry limit specified below.

• A maximum of 500,000 entries per Entrant for the duration of this Promotion Period.

Note: Ineligibility Clause – Promoter Affiliates:

Employees of the Promoter and any member of their immediate family (defined as a spouse, de facto partner, child, or sibling) are ineligible to enter or win any prizes in this Competition (or any other competition run by the Promoter).

7. Entry Package Conditions:

• Customers can purchase: a One-Time Package; or an ongoing Member Package, each with their own distinct benefits and entry type into this Competition.

• One-Time Package entries are valid only for this Competition and will not carry forward to any subsequent draws or competitions.

• Member Package entries, do carry forward and accumulate across subsequent draws and competitions in accordance with the Promoter’s membership program.

• Entry is only valid if the payment has been successfully processed.

• Once a One-Time Package has been purchased and entries have been allocated, no refunds will be provided except as required by law, including the Australian Consumer Law. Entrants may contact the Promoter within 48 hours of purchase if they believe they have purchased the incorrect package type or wish to inquire about their purchase.

Notes:

• All vehicles are provided as advertised. This may include pre-owned, demonstrator or new models where applicable. The condition and specifications of each prize will be as described in the relevant competition materials. Where a prize (being a vehicle or otherwise) becomes unavailable, the Promoter reserves the right to substitute the prize with another prize of equal or greater value, (which for the avoidance of doubt may also be pre-owned, new, or demonstrator). The Promoter may also elect to offer payment in cash in lieu of the prize (which is in its absolute discretion), or to offer the cash equivalent at the Promoter’s discretion.

• Prize value is inclusive of vehicle transfer costs. Roadworthy certificates, registration, insurance, and on-road costs are the sole responsibility of the Winner.

• Prizes (once chosen) are not redeemable for other products or services and are not transferable or exchangeable except at the Promoter’s discretion. Once the First Prize Winner has selected a first prize option (if available) and the prize has either been delivered, transferred, or payment has been submitted to the Winner’s nominated account, the selection is final. No changes, substitutions, or exchanges will be permitted after this point. It is the responsibility of the Winner to confirm their choice (if made available by the Promoter) prior to finalisation.

• For Gift Card Prizes, the Promoter will arrange for electronic delivery of the gift card to a Winner to their nominated email address. All gift cards and vouchers are valid until the expiry date specified by the prize provider, and are subject to any terms and conditions imposed by the prize provider. The Promoter is not liable for any gift card or voucher that has been lost, stolen, forged, damaged or tampered with in any way once awarded.

• Prize delivery must be to an Australian metropolitan address. Cash prizes are paid into an Australian bank account nominated by the Winner.

• For Vehicle Prizes, Vehicle collection timeframes may vary due to manufacturing, registration, or logistics requirements. If the Prize includes custom or aftermarket modifications, the winner acknowledges that replacement parts may not be available indefinitely and the Promoter makes no guarantees as to the suitability or use of those changes. Any ancillary costs associated with prize redemption or use (such as ongoing maintenance, fuel, insurance, or storage) are the sole responsibility of the Winner.

• As a condition of accepting a Prize, the winner may be required to sign a declaration and release in a form reasonably required by the Promoter, provided that such release does not exclude or limit any rights the winner has under Australian consumer law.

• The Promoter reserves the right, subject to regulatory approval where required, to substitute, withdraw or vary any prize (or part thereof) if the prize becomes unavailable for reasons beyond the Promoter’s reasonable control. Where a prize is substituted, the replacement prize will be of equal or greater value. The Promoter may remove a prize from the prize pool without replacement where necessary, provided that the remaining prize pool continues to be awarded in accordance with these Terms and Conditions.

• Nothing in these Terms and Conditions limits, excludes, or modifies any consumer guarantees under the Australian Consumer Law that cannot be lawfully excluded.

PART C – ENTRY AND DRAW PROCEDURE

1. Method of Entry:

• To enter, customers must purchase: a One-Time Package; or an ongoing Member Package.

• It is the responsibility of each Entrant to ensure they meet all Eligibility Requirements and purchase a valid Member Package or One-Time Package for this Competition.

• Entrants must ensure they purchase the correct One-Time Package designated for this Competition. Upon successful purchase, the entries to the draw will be applied. Purchase of a One-Time Package designated for a different competition will not grant entry into this Competition. The Website clearly distinguishes between package types, and all purchase confirmations will specify the competition type.

• Entrants who believe they have mistakenly purchased the wrong package type should contact the Promoter within 48 hours at mkbarberaustralia@gmail.com

• The Promoter is not liable for entries that are incomplete, invalid, or submitted by ineligible participants. Incomplete, invalid, or fraudulent entries will be disqualified.

• Entrants are solely responsible for ensuring their contact details are accurate and up to date.

• Incomplete, invalid, or fraudulent entries will be disqualified.

2. Draw Procedure:

• The draw will be conducted electronically using a certified third-party random draw system, ensuring compliance with applicable regulatory standards.

• Winners will be selected randomly and fairly from all eligible entries received prior to the End Date.

• The first valid entry randomly drawn from all valid entries received prior to the End Date will win the First Prize.

• The second valid entry randomly drawn from all valid entries received prior to the End Date (excluding previous winning entries) will win the Second Prize.

• The third valid entry randomly drawn from all valid entries received prior to the End Date (excluding previous winning entries) will win the Third Prize.

• The draw will be conducted at the Promoter’s registered address or at such other location as approved by the relevant gaming authority.

• At the time of each First, Second and Third Prize Draw, the Promoter will draw five (5) reserve entries (each a Reserve Winner) for each prize category. Reserve Winners will be recorded in the order in which they are drawn. A Reserve Winner will only be entitled to receive a Prize if: (a) the original winner is ineligible, cannot be contacted, or fails to comply with these Terms and Conditions; or (b) the original winner forfeits or declines a Prize; or (c) a Prize remains unclaimed within two (2) months of the draw date.

3. Winner Notification and Publication:

• Winners will be notified within seven (7) days of the draw via the phone number and email address provided at the time of entry. The Promoter will adopt all reasonable endeavours to contact Winners, including at least three contact attempts via different methods.

• The Promoter shall not be held responsible for any failure to notify the Winner due to incorrect contact details submitted by the Entrant.

• Reserve Winners will not be notified unless and until they become entitled to receive a Prize under these Terms and Conditions.

• Winners will be announced publicly via the Promoter’s Website and social media channels within fourteen (14) days of the draw, for a period of at least 28
