MK Barber Motorcycle Raffle – Terms & Conditions

1. Promoter

This raffle is conducted by MK Barber (“the Promoter”) in accordance with the Gambling Regulation Act 2003 (Victoria), applicable Victorian regulations, and the conditions of any permit issued by the Victorian Gambling and Casino Control Commission (VGCCC).

The Promoter will obtain all permits and approvals required before ticket sales commence.

2. Eligibility

• Entry is open to Australian residents aged 18 years or over.
• Employees, immediate family members and associates of MK Barber may only enter where permitted by Victorian law.

3. Prize

The major prize consists of:

• One motorcycle with an approximate retail value of AUD $18,000.

Please note: Victorian raffle laws generally do not permit cash prizes in raffles. If a cash alternative is intended, MK Barber will obtain appropriate legal advice and ensure the promotion complies with all Victorian legislation before commencement.

The prize is not transferable or exchangeable except where required by law.

4. Ticket Sales

5. Draw Details

The draw will be conducted fairly and randomly in accordance with Victorian legislation.

6. Winner Notification

The winner will be contacted by telephone and/or email within 48 hours of the draw.

The winner’s first name, surname initial and suburb may also be published on MK Barber’s website and social media pages where required by law.

The prize will be awarded within 28 days of the draw.

7. Identification

The winner must provide suitable photo identification before taking possession of the prize.

8. Minimum Fundraising Target

MK Barber has established a minimum fundraising target to enable the raffle to proceed.

If the minimum fundraising target is not achieved, MK Barber reserves the right to cancel the raffle.

In that event:

• reasonable expenses directly associated with operating and promoting the raffle, including permit fees, payment processing fees, advertising and administration costs, will first be deducted from the funds raised;
• the remaining net proceeds will be donated to the nominated registered charity;
• entrants will be notified of the cancellation.

Where required by Victorian law or by the conditions of any permit, refunds will be provided to ticket holders. These Terms and Conditions do not limit any rights participants have under applicable law.

9. Liability

Except where prohibited by law, MK Barber accepts no responsibility for lost, late, stolen or damaged tickets or entries.

Nothing in these Terms excludes any rights under the Australian Consumer Law.

10. Privacy

Personal information collected will only be used for:

• administering the raffle;
• contacting prize winners;
• complying with legal obligations.

Information will not be sold or disclosed to third parties except where required by law.

11. Record Keeping

MK Barber will maintain all records required under Victorian legislation relating to ticket sales, the draw, prize distribution and the allocation of proceeds.

12. General

By purchasing a raffle ticket, entrants agree to these Terms and Conditions.

MK Barber reserves the right to amend these Terms where necessary to comply with Victorian law or any conditions imposed by the Victorian Gambling and Casino Control Commission.
